RE: The tariff classification of a rug from China

Dear Ms. Schmidt:

In your letter dated August 10, 2015 you requested a tariff classification ruling. A sample accompanied your letter. The sample will be returned to you at your request less a portion retained for file purposes.

The submitted sample of Item XV-04 is a swatch of a hand knotted pile rug. Photographs taken during the production of the rug, including one on the loom, were provided.  You state the rug’s pile surface is made from 100 percent jute yarns and the warp yarns are made from 100 percent cotton. The rug features finished edges and will measure approximately 65 ½” x 102” when imported.

The applicable subheading for Item XV-04 will be 5701.90.1010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Carpets and other textile floor coverings, knotted, whether or not made up: Of other textile materials: With pile inserted and knotted during weaving or knitting: Hand knotted.” The rate of duty will be Free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on the World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Kim Wachtel at [email protected].
